Terms and Conditions of Sale

These terms and conditions apply to the sale of all products by SMALL RAVE to any purchaser. By placing an order with the Seller, the Buyer agrees to these terms and conditions.

1. Orders and Acceptance The Buyer may place orders for Products through the Seller’s website, email, or other forms of communication. All orders are subject to acceptance by the Seller. The Seller reserves the right to refuse any order for any reason.

2. Prices and Payment Prices for Products are as stated on the Seller’s website or other communications. All prices are in New Zealand dollars and are exclusive of GST unless otherwise stated. The Buyer must pay for Products in full before the Seller will dispatch the Products. Payment can be made by credit card or other agreed-upon payment methods.

3. Delivery The Seller will make every effort to deliver the Products to the Buyer within the timeframe agreed upon between the parties. The Buyer is responsible for providing accurate delivery information to the Seller. The risk of loss or damage to the Products passes to the Buyer upon delivery.

4. Warranties and Returns The Seller warrants that the Products will be free from defects in materials and workmanship at the time of delivery. If the Buyer discovers any defects or non-conformities in the Products, the Buyer must notify the Seller within 30 days of delivery. The Buyer must return the defective Products to the Seller at the Buyer’s expense. If the Seller confirms that the Products are defective, the Seller will provide a replacement or refund.

5. Limitation of Liability To the extent permitted by law, the Seller will not be liable to the Buyer or any third party for any indirect, consequential, incidental, or punitive damages arising out of or in connection with the Products or the Buyer’s use of the Products. The Seller’s liability for any claim arising out of or in connection with the Products will be limited to the price paid by the Buyer for the Products.

6. Force Majeure The Seller will not be liable for any failure to perform its obligations under these terms and conditions if such failure is due to events beyond its control, including but not limited to natural disasters, strikes, and government actions.

7. Governing Law and Jurisdiction These terms and conditions will be governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of New Zealand.

8. Miscellaneous These terms and conditions constitute the entire agreement between the parties with respect to the sale of Products and supersede all prior negotiations, representations, and agreements. These terms and conditions may not be amended except in writing signed by both parties. Any waiver of any provision of these terms and conditions will not be deemed a waiver of any other provision. If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
